How do I find ICBC awards and arbitration decisions?
Last revised November 29, 2023

ICBC decisions of awards and arbitrations concerning Insurance (Vehicle) Act, ICBC Commercial Arbitration, and Underinsured Motorist Protection (UMP) Arbitration are kept in each individual's file. ICBC has no central depository for the awards and arbitrations.

However, as of June 21, 2007, UMP arbitration decisions as required by section 148.2 (2.1) of the Insurance (Vehicle) Regulation  (BC Reg #447/83) are now posted on the ICBC website.

I thought UMP decisions were deposited with the Supreme Court Library

No.

Section 74(b) of BC Reg #166/2006 amended section 148.2 of the Revised Regulation (1984) under the Insurance (Motor Vehicle) Act to add subsection 2.1. "An arbitrator who adjudicates a dispute under this section must publish the reasons for the decision by forwarding a copy of the reasons, with personal information that would identify the parties deleted, to the head librarian at the library of the Supreme Court and Court of Appeal at the Courthouse in Vancouver."  This came into force on June 1, 2007.

However, BC Reg #212/2007, amended section 148.2 (2.1) of the Insurance (Vehicle) Regulation by striking out "to the head librarian at the library of the Supreme Court and Court of Appeal at the Courthouse in Vancouver" and substituting "to the corporation for publication on its website".  This came into force on June 21, 2007.

During that time, no decisions were deposited with the library.

Those are two different regulations and acts

No.

The Insurance (Motor Vehicle) Act was re-titled the Insurance (Vehicle) Act by the Insurance (Motor Vehicle) Amendment Act, 2003, SBC2003, c. 94, s. 1, effective June 1, 2007 (also by BC Reg #166/2006).

The Revised Regulation (1984) was re-titled the Insurance (Vehicle) Regulation by section 1 of the Schedule to BC Reg #166/2006, effective June 1, 2007.
