Judicial reviews of provincial tribunals are heard by the BC Supreme Court. There is not an automatic right to review, nor is it a re-hearing. Reviews are governed by the Judicial Review Procedure Act, R.S.B.C.1996, c. 241 and sections 57 to 59 of the Administrative Tribunals Act, S.B.C. 2004, c. 45.
Commentary on procedure can be found in British Columbia practice. A sample petition and affidavit are published in British Columbia court forms.
Procedure for reviewing decisions of federal tribunals is governed by the Federal Courts Act, R.S.C. 1985, c. F-7, section 18.1 and Part 5 of the Federal Courts Rules (SOR/98-106).
