Post Nov 15, 2019 - Changes in legislation affecting land title forms electronic filing

Electronic filing (e-filing) of land title forms was recently affected by amendments to the Land Title Act, R.S.B.C. 1996, c. 250, which were brought into force by B.C. Reg. 171/2019 on November 15, 2019 under the Land Statutes Amendment Act, 2018, S.B.C. 2018, c. 37, s. 18 (Bill 37).

Key changes to legislation include the repeal and replace of Part 10.1 - Electronic Filing, including revised terminology, elimination of unnecessary true copy requirements and elimination of duplicative provisions related to e-filing of applications, instruments and plans.

The Miscellaneous Statutes Amendment Act (No. 2), 2010, S.B.C. 2010, c. 6, s.15 (in force by royal assent on June 3, 2010), amended the Land Title Act, R.S.B.C. 1996, c. 250 with the addition of section 168.111. 

Section 168.111 sets out the legal framework that empowers the Director of Land Titles of the Land Title and Survey Authority of BC (LTSA), to require that documents be filed electronically rather than in hardcopy format.

Requirements to file land title forms electronically are being introduced in phases, with each phase specifying groups of similar application types that must be filed electronically. Upon completion of all phases, most documents and plans will be filed electronically with a very small number filed manually in hardcopy form.

The requirement to e-file posting plans will take effect July 1, 2011 and requirements to e-file specific Land Title forms will take effect January 16, 2012.
