Both spellings are considered correct and both are used. In Pitzel et al. v. Children's Aid Society of Winnipeg [1984] 5 W.W.R. 474 the Court stated:
"From this variety of usage, it appears that either a number of usages are acceptable or no one has yet emerged as the correct and acceptable one in Canadian Law" (Law of intervention: Status and practice, p. 3).
