Pharmacare was originally authorized by the Guaranteed Available Income for Need Act Regulation, BC Reg 479/76, s.30.
In 1995, the Continuing Care Act was amended by the Health Statutes Amendment Act, S.B.C. 1994, c. 42, adding section 1.2 to allow the Lieutenant Governor in Council to prescribe the type of health care services provided under the Act. At the same time, BC Reg 146/95 was issued, prescribing Pharmacare as a continuing care program under the Continuing Care Act. Subsequently, section 30 of the Guaranteed Available Income for Need Act Regulation was repealed by BC Reg 402/95.
With publication of the Revised Statutes of British Columbia 1996, section 1.2 of the Continuing Care Act was re-numbered as section 3.
