What is a bar order?
Last revised September 07, 2022

Bar orders are used in class actions when there are multiple defendants and some of these defendants want to settle.  A bar order is included in the court's order approving the settlement. It prevents the non-settling defendants from making claims against the settling defendants.

An example of "bar order" language can be found in a Supreme Court Order dated July 19, 2001 in Killough v. Canadian Red Cross, Vancouver Registry C976108. See paragraphs 30 to 33. A copy may be obtained from the Vancouver Courthouse Library; order via the Unreported Decisions Index.
